Terms of Service

Welcome to Miracle Fertility. We support our users in understanding reproductive health and taking proactive, non-medical steps toward fertility preservation. By accessing or using the Platform — including our website, applications, digital content, consultations, products, and tools (including those of third-party providers) (collectively the “Platform”) — you (the “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must refrain from using the Platform.

Important notice. Miracle does not provide medical services, medical advice, diagnosis, treatment, or telemedicine. All content, recommendations, and consultations are non-medical and for general informational and educational purposes only.

§ 1 Scope and Subject Matter

  1. These Terms govern all contracts between Miracle Fertility UG (haftungsbeschränkt), accessible under the domain miraclefertility.de and its associated subdomains, and Users of the Platform.
  2. The Platform makes available a digital content library on fertility, nutrition, lifestyle, and reproductive health (“Content Library”); non-medical consulting services (“Consulting Services”); and access to selected third-party offerings linked from the Platform (collectively “Services”).
  3. Deviating, conflicting, or supplementary terms of the User do not become part of the contract unless Miracle has expressly agreed to their validity in text form (§ 126b BGB). This requirement applies even if Miracle performs services unconditionally in knowledge of such terms.
  4. The current version of these Terms can be accessed, saved, and printed at all times.

§ 2 Access Options

  1. Access to the paid areas of the Platform is offered through the following service models: Self-guided, Supported Cycle and Guided Cycle. The exact prices, terms, and included features at the time of order are set out on the Platform and are incorporated into the contract together with the order page shown to the User at checkout.
  2. Our “Self-guided” recurring subscription includes full access to the Content Library, automatically renews for successive monthly or annual terms depending on the choice of the User.
  3. Our “Supported Cycle” is a one-off 12-week program, including full access to the Content Library for the program duration plus Consulting Services consisting of a video call and text-based support by the Miracle team.
  4. Our “Guided Cycle” is a one-off 12-week program, including full access to the Content Library for the program duration plus Consulting Services consisting of up to three video calls and text-based support by the Miracle team.
  5. Members of Miracle’s partner organisations (“Partners”) may generate a voucher code through the relevant Partner’s interface and redeem it on the Platform for the included offerings and validity periods determined by the Partner. Vouchers are personal, non-transferable, single-use, and have no cash value. Vouchers cannot be combined with paid subscriptions for the same period. The User may at any time purchase any other offering not accessible to them via their voucher.

§ 3 Contract Formation; User Account

  1. User account. A personal account is required to access the Platform and Services. The User must keep login credentials confidential, prevent misuse, and must not share the account with third parties. The User is responsible for any use of the account except where the User is not at fault for the unauthorized use.
  2. Offer.The User submits a binding offer by selecting the relevant Service, entering the required information (including payment details) and accepting the Terms by clicking the designated button (e.g., “Subscribe now (subject to payment)” or “Buy now (subject to payment)”). For voucher access, the User submits an offer by entering the voucher code, accepting these Terms.
  3. Acceptance.The contract is concluded when Miracle accepts the offer. Acceptance occurs by Miracle sending an order confirmation to the User’s e-mail address; and for voucher access, by completing Miracle’s verification of the voucher.

§ 4 Payment

Payment is made via the payment methods offered on the Platform at checkout, processed by third-party payment service providers. By concluding the contract, the User authorizes Miracle to collect the amounts due. The User may only set off claims against Miracle that are undisputed or legally established. The User may exercise rights of retention only insofar as the underlying claims arise from the same contractual relationship and are undisputed or legally established.

§ 5 Term and Termination

  1. The Self-guided subscription contract and billing period starts on the date of checkout confirmation. The User may terminate at any time with effect to the end of the then-current billing period (monthly or annual). Termination takes effect at the end of the current billing period; the User retains access until that date. No pro-rata refund is owed.
  2. Supported and Guided Cycle programs and contracts start on the date of checkout confirmation. The contract ends automatically at the end of the 12-week term; no automatic renewal. The User may pause the program once for up to eight (8) weeks if the underlying freezing cycle is postponed for documented reasons (e.g., postponement by the treating clinic, medical hold).
  3. Terminations and pause requests are made via the cancellation function in the User account or in text form to info@miraclefertility.de. The pause must be requested before the start of the calendar week to be paused.
  4. On termination the User retains access to the Services associated with the terminated contract until the end of the billing period. During a pause the program term and any unused Consulting Services are suspended and resume on the agreed restart date. If a paused program is not resumed after a maximum of eight (8) weeks, the contract and access automatically ends at the end of the 12-week term.

§ 6 Right of Withdrawal; Express Consent and Acknowledgment

The right of withdrawal expires before the end of the 14-day period as follows: The right of withdrawal expires when Miracle has fully performed the service, provided that Miracle began performance only after the User requested that performance begin within the withdrawal period; and acknowledged that, by giving this request, the User will lose the right of withdrawal upon full performance by Miracle.

§ 7 Intellectual Property; Licence

  1. All content on the Platform is protected by copyright. All rights remain with Miracle or its licensors.
  2. On conclusion of the contract, the User receives a simple (non-exclusive), non-transferable, and non-sublicensable right to use the digital content solely for the User’s own private, non-commercial purposes and for the duration of the relevant contract term.
  3. Prohibited uses include in particular:
    1. reproduction, distribution, or public access outside legally permitted uses;
    2. permanent storage, systematic collection, or disclosure to third parties;
    3. editing, translation, modification, or other alterations except as legally permitted;
    4. reverse engineering, decompiling, disassembling, or circumventing technical protection measures; and
    5. sharing or joint use of login data, vouchers, or subscriptions with third parties.
  4. In the event of a breach, Miracle may suspend access permanently and terminate the contract without notice. Statutory and contractual rights, including claims for damages, remain unaffected.

§ 8 Assignment

  1. The User may not assign or transfer any rights or claims under these Terms without Miracle’s prior written consent.
  2. Miracle may assign its rights and obligations under these Terms to third parties.

§ 9 Services and Availability

  1. Miracle provides the Services as described in the relevant service description on the Platform at the time of contract conclusion.
  2. Miracle may adjust, modify, or remove content, features, or services for valid reasons (in particular technical, legal, or product-related reasons). Users will be informed in advance, within a reasonable time, about significant changes affecting access, programs, or other paid services already concluded.
  3. Continuous availability cannot be guaranteed; downtime and scheduled maintenance may occur. Miracle will, where reasonably possible, notify Users of planned maintenance in advance.

§ 10 No Medical Treatment; Disclaimer of Responsibility

  1. All content, programs, recommendations, consultations and any other Services provided via the Platform — whether digital, in person, via third-party providers, AI tools, or any other medium — are intended solely for general educational and informational purposes.
  2. Miracle does not provide medical examinations, consultations, diagnoses, therapies, or medical devices. The Platform, its content, and the products and services offered do not constitute medical treatment, medical advice, or telemedicine.
  3. The content is general in nature and is not tailored to any User’s personal situation. It does not replace professional medical advice, diagnosis, or treatment by doctors, dietitians, nutritionists, or other licensed healthcare professionals.
  4. Miracle provides no guarantees of healing, treatment success, pregnancy, fertility improvement, or any other health outcome. Any references to potential effects or outcomes are based on general knowledge or preliminary.
  5. Supplements are not medicines; they are not intended to diagnose, treat, cure, or prevent any disease. Users must consult a licensed healthcare professional before using supplements or tests, in particular if they have pre-existing conditions, are pregnant, are planning a pregnancy, have intolerances, or are taking medication.
  6. Use of all content, consultations, and products is at the User’s own risk. Users must consult a qualified doctor, dietitian, or other licensed healthcare professional before making changes to their diet, supplementation, or lifestyle on the basis of Miracle’s content, and immediately in the event of questions, complaints, or health concerns.

§ 11 Liability

  1. Miracle is liable without limitation for intent, gross negligence, and for injury to life, body, or health. Mandatory statutory liability remains unaffected.
  2. Miracle assumes no liability for the application of recommendations, lifestyle changes, supplement use, test kits, consultations, or third-party content or services beyond the foregoing.
  3. Where Miracle’s liability is limited or excluded under these provisions, this also applies to the personal liability of its legal representatives, employees, and agents.

§ 12 Data Protection

  1. Miracle processes personal data where necessary for the performance of the contract, to comply with legal obligations, or on the basis of legitimate interests.
  2. Where health or genetic data are processed, this occurs only on the basis of the User’s explicit consent or where otherwise permitted by law.
  3. Details are set out in Miracle’s Privacy Policy.

§ 13 Amendments to these Terms

  1. Miracle may amend these Terms with effect for the future where there is a valid reason, in particular a change in the legal or regulatory framework or in case law, a technical development, or an adjustment to the range of services.
  2. The amendments are deemed accepted unless the User objects in text form before the effective date. If the User objects, the contract continues on the existing Terms; in that case Miracle may terminate the contract with effect to the end of the current billing period.

§ 14 Final Provisions

  1. German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. Place of jurisdiction, to the extent legally permissible, is Berlin.
  3. If any provision of these Terms is invalid or unenforceable, in whole or in part, the validity of the remaining provisions is unaffected; in place of the invalid provision.
  4. The contract language is German. Translations of these Terms into other languages are provided for convenience; in case of discrepancies, the German version prevails.
  5. The European Commission provides an online dispute resolution platform (ODR) at https://ec.europa.eu/consumers/odr/. Miracle will not participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Consumer Dispute Resolution Act (VSBG).

Withdrawal Policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us — Miracle Fertility UG (haftungsbeschränkt), Leibnizstraße 101, 10625 Berlin, e-mail: info@miraclefertility.de — of your decision to withdraw from this contract by an unequivocal statement via e-mail. You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested that the performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the time you have informed us of your withdrawal from this contract, in comparison with the full coverage of the contract.

Premature expiry of the right of withdrawal

  • In the case of a contract for the provision of services, your right of withdrawal expires if we have provided the service in full and only began performing it after you gave your express consent and confirmed your awareness that you would lose your right of withdrawal once we had fully performed the contract.
  • In the case of a contract for the supply of digital content not on a tangible medium, your right of withdrawal expires if we have begun to perform the contract after you (1) expressly consented to our beginning performance before the end of the withdrawal period, (2) confirmed your awareness that by giving your consent you lose your right of withdrawal at the start of performance, and (3) we have provided you with a confirmation of the contract in accordance with § 312f BGB.
